Teen Facing Spanish Sex Charges Speaks Out

Alleged Victim, Teen Must Return To Spanish Court

The Norton teen held in a Spanish jail for more than a month told his side of the story Thursday.

NewsCenter 5's Pam Cross reported that William McGrath was arrested after a classmate accused him of rape during a spring break trip to Spain.

The teen's attorney said McGrath, the alleged victim and her roommate spent the last day of the April trip together at the beach and playing pool. That night, McGrath and the complainant were in his hotel room. The next day, he was arrested while sitting on the plane waiting to go home.

"I just feel totally elated that I am back home. It was a horrible experience being in Spain so far away -- 5,000 miles away from home," McGrath said.

McGrath, 19, a senior at Norton High School, spent 33 days in a Spanish jail. He said the sexual encounter with a classmate was consensual, she said it was rape.

A Spanish judge recently dismissed the rape charge and allowed the teen to return home on bail. A sexual misconduct charge remains. Both McGrath and the alleged victim must return to a Spanish court on July 7.

"He is going back whenever that trial date is set, he is going back. Whatever the cost is, whatever the time he has to take off his schedule, whether he has to take time off from school -- he is going back to vindicate his name," said defense attorney Julio Hernando.

Hernando said the judge never heard from the roommate of the complainant.

"There was consensual sexual relations that took place. Billy never denied that -- he never denied that he had sex with the girl," Hernando said.

Hernando said the alleged victim voluntarily went to McGrath's room. She told authorities that when he tossed her on the bed, she hit her head and lost consciousness.

"She was examined at a medical facility and there was no evidence of any trauma," Hernando said.

McGrath said his month in jail was scary, and at one point, he was threatened.

"There was actually a time when there was razor taken out in front of me. This kid was waving it and he was saying, 'Americano, tu no sabe nada,' -- you know nothing. I didn't know what anyone was saying," McGrath said.

The alleged victim's attorney, Wendy Murphy, released a statement Thursday that read, in part, "The victim has been cooperating and working with international and Spanish law enforcement officials from the beginning and will continue to provide consistent and truthful evidence demonstrating that Mr. McGrath is guilty as charged."  

McGrath was served with a stay away order from North High School, the alleged victim and her family. His attorney is finding out what McGrath has to do to graduate and go to college.

The alleged victim returned to school two days after the trip.
