Full Text: Bob Dougherty's Lawyer Defends Client

FOR IMMEDIATE RELEASE

Mr. Dougherty never claimed to have been stuck in a toilet seat at the Nederland Visitor's Center, and is eager to take a polygraph arranged and paid for by any reputable new agency or TV station. He will do so today if we can arrange for a polygrapher to come to Nederland.

The Home Depot incident took place in October of 2003, PRIOR to this alleged incident in Nederland in 2004. Photographs, ambulance reports, ER reports, fire department reports, and records of Mr. Dougherty's doctors all show beyond any doubt that Mr. Dougherty was glued to a toilet suit at the Home Depot store in Louisville in October of 2003 and suffered serious and long-lasting injuries as a result. Mr. Dougherty will share those records with all media outlets.

The Nederland Police Department and the Nederland Fire Department have no record of Mr. Dougherty ever making a report claiming to have been glued to a toilet in Nederland in 2004, and the Town of Nederland has no record of such a claim. There are no medical records that indicate Mr. Dougherty made any such claim in 2004.

Mr. Trzepacz left the Town as a result of a well-publicized political battle in which he, Town Clerk Sheridan Garcia, and other Town employees claimed that Nederland Police Chief Ken Robinson had been too aggressive in enforcing drug laws and other laws within the Town, and that the police department was receiving a disproportionate share of the Town's revenue. Mr. Dougherty, a Vietnam veteran, spoke out on behalf of Chief Robinson, and the Town employees knew that. It may be that Mr. Trzpacz and others parroting his claim, saw this as an opportunity to retaliate against Mr. Dougherty.

It is unfortunate that certain publications reported this story without first giving Mr. Dougherty or his attorney a chance to comment on it.

Jurors in Boulder County are well educated, and when all the legal maneuvering is done, and they have heard the testimony and seen the evidence, we are confident that the jurors will find that Home Depot was negligent in maintaining the restroom, that it violated its own promises, and that Mr. Dougherty has suffered serious and long-lasting injuries as a result.
