A 2-year-old Rehoboth boy allegedly beaten by his mother has died and authorities now say they will be charging her with murder.

A spokesman for the Bristol district attorney's office said the child, Timothy Peno, died Friday morning at Hasbro Children's Hospital in Providence, R.I.

"The child received substantial injuries to the child's head, face and torso," said Gregg Miliote, spokesman for the Bristol County District Attorney Sam Sutter.

The mother, Kim H. Peno, 38, was originally charged with assault and battery of a child causing substantial injury.

She was held without bail at her arraignment Thursday in Taunton District Court pending a competency evaluation.

Peno will be arraigned on the murder charge Monday morning in Taunton District Court.

Peno's lawyer said his client has a history of mental health issues.

"We will look into this case with the possibility there are mental health issues," defense attorney Robert Sinsheimer said. "She's grieving her child."

Police said the child's father went to police headquarters in nearby Seekonk just after midnight Thursday seeking assistance for the boy, who suffered head and torso injuries.

Authorities said Kim Peno was with him.
