BOSTON -- It's been more than a week since an elderly driver crashed into a Danvers store and struck a mother and her baby.

NewsCenter 5's Jack Harper reported that the 1-year-old is facing a long recovery, and the family is looking for justice.

Makayla Hayes spent nine days at Massachusetts General Hospital. She was thrown from a carriage when a car plowed into the Danvers Wal-Mart on June 2.

Late Wednesday, the baby was moved to Spaulding Rehabilitation Center.

"Physical therapy is taking place. They are working on building muscle tissue and mobility and some speech," said Barry Feinstein, the family's attorney. "All things considered, I think the family is doing as well as can be expected."

The driver, Louis Vesprini, 93, has not been formally charged by the Essex County District Attorney, but the Hayes family has filed a civil lawsuit.

"We are looking for payment of medical and rehabilitation bills, loss of income and compensation for pain and suffering," Feinstein said.

Feinstein is still considering whether to bring legal action against Wal-Mart.

There are stills concerns about Makayla's cognitive functions, but overall she's doing OK.

Feinstein said his clients are about as innocent as any victims can be, and they must be compensated.
