Mass. Judge Says Sorry In OUI Case
McEvoy Loses License For 45 Days

BOSTON -- Massachusetts Superior Court Associate Justice Christine M. McEvoy appeared in Concord District Court Friday and apologized after admitting to sufficient evidence in an April OUI arrest.Lexington Police said they pulled McEvoy over Apr.15 on Interstate 95 in Woburn after another driver noticed her car swerve on the road."As he observed the vehicle he saw that it swerved more than once in its own lane of travel, and then veered over the center lane line once. The officer noted when he approached Ms. McEvoy that her eyes were red, bloodshot and glassy, her speech was slurred. He also smelled an odor of an intoxicating liquor coming from her breath," prosecutor Jen Kirshenbaum told the court.McEvoy did not take a field sobriety test but told the officer she had had " a couple glasses of wine," according to the police report. She was charged with operating under the influence.McAvoy, who sits in Middlesex Superior Court in Woburn, has presided over some high-profile court cases, including the murder trial of Dr. Richard Sharpe, who was convicted of murdering his wife a few years ago.In court before Judge David Ricciardone, McEvoy apologized to the people of Massachusetts, her parents, friends and her colleagues on the bench, saying "I take full responsibility," for the incident.The judge continued the case without a finding and McEvoy was ordered to participate in a first-offender alcohol program and told to pay more than $600 in fees and fines associated with case. She also loses her driver's license for 45 days.McEvoy was placed on probation for one year and if no further incidents occur the charge will be dropped from her record.
