BOSTON -- On the fourth day of a judicial misconduct hearing, Judge Maria Lopez said that she was upset at an assistant district attorney because she believed the prosecutor created a "media circus."
NewsCenter 5's Amalia Barreda reported that Lopez testified that transgendered defendant Ebony Horton was set to plead guilty to kidnapping and assaulting an 11-year-old boy on Aug. 4, 2000, but Lopez continued the case until Sept. 6, because she believed an assistant district attorney had tipped off the press."I came to the conclusion that it was Miss [Leora] Joseph, as the line ADA, that had provided information about this case to the press office," Lopez said. "Particularly because there were some unique facts in that press release that only the line DA would know about."Lopez said that she was displeased with the prosecutor, but she said that it did not result in bias against her."Judges regularly get annoyed and mad at lawyers," Lopez said.That comment was stricken from the record after the special prosecutor objected.Lopez also testified that even though the prosecution was upset about the sentence of probation for Horton, prosecutors never tried to get her to change her mind and never sought a dangerousness hearing on Horton.
