Fair Worker Released When Some Charges Dropped

Alleged Victims Recant Story, Police Say

Some of the charges against a carnival worker who was accused of raping two teen girls have been dropped, and the man was released from jail on personal recognizance on Friday.

Marshfield fair worker Jeffrey D. Witham of Oxford, Maine, was accused of raping the girls, ages 13 and 14, at one of the girl's homes.

Charges of aggravated rape, kidnapping and assault against Witham were dropped Friday.

The girls told police that they had met Witham at the fair and he went to one of their homes on Sunday. There, the girls claimed, he raped them. The girls said they tried to run from the house, but he chased them and dragged one of them into the woods, police said. One of the girls then called her father, who called police.

The Plymouth County District Attorney's Office said both girls changed their stories when police interviewed them again.

"A setup from the beginning. These girls intended to go to this fair and certainly sought out someone to have sex with," defense attorney Kathleen Iaccarino said.

Witham still faces one count of rape of a child with force, two counts of statutory rape, and one count of indecent assault and battery on a person under 14.

"The 14-year-old was presenting herself as either 16 or 18 to him at the time, and had fake identification, as well," defense attorney Michael Bergeron said.

Friends of the girls reportedly told investigators about the plot.

"It was a definitely a plan. We have evidence of that. It appears the plan was all but carried out," Bergeron said.

Witham lives with his grandmother in Maine. He has a girlfriend and a 5-month-old child.

"I'm relived to see that Jeffrey's going to be coming home, and that people are realizing that this isn't something he did," Doris Witham said.

The girls could also face charges.
