Attorney Says Surgeon Fell Asleep During Procedure

A plastic surgeon fired by Beth Israel Deaconess Medical Center after he appeared to fall asleep while performing a liposuction is now being sued by that patient.

NewsCenter 5's Janet Wu reported that the patient is also suing the hospital and other nurses and doctors who he said could have prevented it.

Attorneys for Michael Hicks said his breast reduction and liposuction procedure on June 27 was performed by a doctor who was clearly impaired and abandoned Hicks before the operation was over.

"It appears Dr. Borud closed his eyes on at least two occasions, and he had to be aroused by the surgical resident," said Hick's attorney, Dr. Max Borten.

The doctor, Loren Borud, had his license suspended last week by the Board of Medicine, which said Borud had bloodshot eyes and had botched a suture on a previous patient that same day.

When the hospital reportedly told Borud to immediately take a drug test, he asked another doctor to provide the urine.

Yet, the state board said it was not informed of this incident until two weeks later, and Hicks himself wasn't told when he called a week after the operation, complaining of chills, bleeding and pain.

Instead, he was told to seek medical care at the Veterans Hospital since he served in the Gulf War.

"Why did no physician, no nurse, no administrator from the Beth Israel Deaconess Mesical Center inform Mr. Hicks of what happened before Mr. Hicks was sent home?" Borten said.

Hicks' attorney said they are suing Borud, the hospital and seven other nurses and doctors at Beth Israel. He said Hicks has suffered permanent physical and emotional damage.

"Mr. Hicks believes that he was let down -- not just by Dr. Borud, but everybody in that operating room who could have stopped that surgery from even getting started," Borten said.
