Family Claims Sudden Unintended Acceleration Led To Fatal Crash

The family of a Medford woman killed in an Oct. 2009 car crash has filed suit against Toyota, alleging that the crash was the result of sudden unintended acceleration.

It's a problem that led to Congressional hearings this week and has forced Toyota to recall more than 8 million vehicles nationwide.

Marianne Murphy, 47, was killed when their 2010 Toyota Camry crashed into the guardrail on Interstate 93 South in Medford. Her husband Gerald Murphy was driving. He was injured.

According to the suit, obtained by Team 5 Investigates Susan Wornick, the Murphys and their children were driving home around midnight after seeing a Halloween display in New Hampshire.

It claims that as Gerald Murphy "began to move to the right-hand lane to prepare to take his exit he removed his foot from the accelerator. The Camry, rather than slowing down, suddenly surged, accelerated, and picked up speed."

The suit goes on to say that Murphy stepped on the brakes, but the vehicle continued to surge, veering across the highway, crashing into guard rails on both sides of the highway.

It claims that by Oct. 18, 2009, the date of the crash, Toyota had received numerous driver reports about its cars speeding out of control.

The lawsuit does not seek a specific dollar amount. It states that Gerald Murphy has suffered emotional and physical pain, which could leave him permanently disabled.

Team 5 Investigates has yet to receive a response from Toyota after inquiring about the allegations in the lawsuit.
